Terms and Conditions of Use for Kanji Blossom

Please read these Terms and Conditions of Use ("Terms") carefully before using the Kanji Blossom mobile application (the "App") operated by Maksymilian Hora ("We", "Us", "Our").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App. By tapping "Continue" (or a similar button) upon first launch, or by accessing or using the App, you agree to be bound by these Terms.

1. License to Use the App (EULA)

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with these Terms. You agree not to, and you will not permit others to:

a) License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App.

b) Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App.

2. In-App Purchase and Premium Features

The App is free to download and use but may offer access to additional features, content, or services through a one-time in-app purchase ("The Complete Experience"). This purchase is voluntary. The price for The Complete Experience will be displayed in the App at the point of purchase and is dependent on your region.

3. Payments

All in-app purchases are processed through the Google Play Store and are subject to its terms and conditions. We do not collect or process any of your payment information.

4. IMPORTANT – Right of Withdrawal for Consumers in the European Union

If you are a consumer based in the European Union, you have a statutory right to withdraw from a contract for the purchase of digital content within 14 days without giving any reason.

Waiver of the Right of Withdrawal: This right of withdrawal does not apply to your purchase of The Complete Experience if you have given your express consent to begin the supply of the digital content during the 14-day withdrawal period and have acknowledged that you consequently lose your right of withdrawal.

By making the in-app purchase for The Complete Experience, you expressly consent to the immediate performance of this contract and the delivery of the digital content. You acknowledge that by doing so, you lose your statutory right to withdraw from the purchase.

5. User-Generated Content

The App may in the future allow you to create your own content, such as custom flashcard decks and notes ("User-Generated Content" or "UGC").

a) You retain ownership of and all intellectual property rights to the UGC you create.

b) To enable the App to function, you grant Us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, store, display, and prepare derivative works of your UGC solely for the purposes of operating, developing, providing, and improving the App and its services.

6. Prohibited Conduct

You agree not to use the App for any purpose that is illegal or prohibited by these Terms. You are responsible for all of your activity in connection with the App.

7. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Disclaimer of Warranties and Limitation of Liability

The App is provided to you "AS IS" and "AS AVAILABLE," with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, We expressly disclaim all warranties, whether express, implied, statutory, or otherwise.

To the maximum extent permitted by applicable law, in no event shall We be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to your use of the App. Our total liability to you for any damages arising from or related to these Terms shall not exceed the amount you paid for the in-app purchase.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms within the App or on our website.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
